In the Name of God

Statement of the High Council for Human Rights of the Islamic Republic of Iran on Disturbing Reports Regarding the Treatment of Protesters in Albania

The High Council for Human Rights of the Islamic Republic of Iran, expressing concern over recent developments in Albania and published reports of clashes between protesters and police forces, emphasizes the necessity of respecting the fundamental rights of citizens, respecting the right to peaceful assembly and freedom of expression, prohibiting arbitrary arrest, and ensuring the accountability of the responsible authorities for any potential violations.

According to reports published in international media, protests intensified in October 2026, particularly in the city of Tirana, with the participation of students and young people. Among the protesters’ demands, issues including protests against administrative corruption, employment difficulties, the quality of education, economic conditions, and calls for the resignation of Edi Rama, the Prime Minister of Albania, have been central to these assemblies. During these protests, reports have emerged of clashes with the police; the use of tear gas, water cannons, batons, and rubber bullets; as well as damage to government buildings and public and private property.

According to media reports dated 17 October 2026, differing figures have been reported regarding detainees and injured persons. One report put the number of detainees at approximately 500, of whom 330 had been released; another reported the arrest of 167 individuals, the initiation of criminal proceedings against 388 individuals, and injuries sustained by 132 police officers. Reports have also been published concerning injuries sustained by a number of protesters. The discrepancies among these figures may stem from differences in publication dates, the time periods covered, and the methods used to categorize the statistics. Therefore, the publication of final, accurate, and verifiable figures by the Albanian authorities is essential.

The concerns are not limited to media reports. In a preliminary statement dated 16 October 2026, the Albanian Ombudsman announced that monitoring teams from the institution had been in contact with 214 persons deprived of their liberty over a period of 72 hours. The institution reported receiving complaints concerning the use of force during arrest, delays in the provision of medical care, non-compliance with certain time limits for detention, and the presence of plainclothes officers lacking identification insignia. Furthermore, during visits to detention facilities, concerns were raised regarding overcrowding, inadequate sanitary and medical facilities, and the conditions in which detainees were held.

The Albanian Ombudsman has also taken note of reports concerning the detention of minors and the questioning of certain persons under the age of majority without the presence of a parent, guardian, or psychologist. The institution has also documented cases of visible signs of violence on persons held in detention, which it stated required further examination. If confirmed, such reports could give rise to serious concerns regarding respect for the rights of detainees and child protection standards, and underscore the need for independent and effective investigations.

The High Council for Human Rights of the Islamic Republic of Iran emphasizes that, pursuant to Articles 9 and 10 of the International Covenant on Civil and Political Rights, the liberty and security of persons must be respected, and persons deprived of their liberty must be treated with respect for their inherent human dignity. Article 14 of the same Covenant also establishes guarantees for a fair trial. Accordingly, any arrest must have a clear legal basis, and access to legal counsel, notification of the reasons for arrest, the opportunity to challenge its lawfulness, and the right to a fair judicial hearing must be guaranteed.

[10/22/2026 9:11 AM] A@sh شیپوری: With regard to minors, the need to comply with the obligations arising from the Convention on the Rights of the Child is all the more important. Deprivation of liberty of children and adolescents must be imposed only in accordance with the law, as a measure of last resort, and for the shortest appropriate period. Access to legal and psychological support, respect for human dignity, and the provision of special safeguards appropriate to their age are among the fundamental requirements governing the treatment of persons under the age of majority. Any allegations concerning the questioning of minors without the necessary safeguards or their detention in inappropriate conditions must be investigated promptly and independently.

The use of force by law enforcement personnel must also comply with the principles of legality, necessity, and proportionality. Under the United Nations Basic Principles on the Use of Force and Firearms by Law Enforcement Officials, authorities must, to the extent possible, employ non-violent means and, where intervention is necessary, use the minimum force required. The use of tear gas, water cannons, or rubber bullets cannot be justified solely on the grounds of the existence of tensions or violent conduct by certain individuals; the necessity and proportionality of each measure must be assessed in light of the specific circumstances, the risk involved, and its consequences.

According to published reports, the Chief of Police of Albania has confirmed the suspension of seven officers pending an investigation into allegations of exceeding the limits of their duties and failing to observe the principle of proportionality. This measure does not, in itself, establish that the officers committed any misconduct; however, it underscores the necessity of conducting independent, impartial, and effective investigations and publishing their findings. Furthermore, the identifiability of officers participating in operations, the comprehensive recording of information concerning detainees, and the ability to lodge and pursue complaints are important safeguards for preventing ill-treatment and strengthening accountability.

The High Council for Human Rights of the Islamic Republic of Iran, while emphasizing the necessity of protecting the life and security of all persons, condemns any and all violence against protesters, law enforcement officers, and citizens, as well as the destruction of public and private property. Nevertheless, the commission of criminal acts by certain individuals does not constitute authorization for collective treatment, arbitrary punishment, or disproportionate restrictions on the rights of other participants in assemblies. The Government of Albania is obligated to distinguish between individuals suspected of committing violent acts and citizens who peacefully put forward their demands.

Pursuant to Articles 19 and 21 of the International Covenant on Civil and Political Rights, freedom of expression and the right to peaceful assembly are considered fundamental rights. Any restriction on these rights must be prescribed by law, pursue a legitimate aim, and, under the specific circumstances, be necessary and proportionate. Protesting administrative corruption, demanding educational reforms, requesting employment opportunities, and expressing dissatisfaction with economic conditions cannot, in and of themselves, constitute grounds for depriving citizens of their fundamental rights. The Government of Albania must, while maintaining public order, ensure the opportunity for the peaceful expression of demands and genuine dialogue with students, civil society groups, and other citizens.
The High Council for Human Rights of the Islamic Republic of Iran also emphasizes the need to refrain from applying double standards in the field of human rights. States that, in their international positions, emphasize freedom of expression, the right to protest, and government accountability must also adhere to those same standards when addressing protests within their own borders.

The credibility of human rights commitments depends on their practical, continuous, and non-selective implementation. These rights cannot be emphasized solely in relation to other countries while silence is maintained in the face of concerns raised regarding their domestic conduct.

Within this framework, the High Council for Human Rights of the Islamic Republic of Iran calls upon the Government of Albania to publish accurate and verifiable statistics on the number of detainees and injured persons; conduct independent and effective investigations into allegations concerning the disproportionate use of force, the conditions of detention, and the situation of adolescents; guarantee the legal rights of detained persons; and, while respecting the right to peaceful assembly and freedom of expression, respond to the economic, educational, and social demands of its citizens through dialogue and practical measures.

In conclusion, the High Council for Human Rights of the Islamic Republic of Iran emphasizes that maintaining public order and protecting the fundamental rights of citizens are two complementary responsibilities of governments. No circumstances can negate the necessity of respecting human dignity, prohibiting arbitrary detention, providing special protection for children, and ensuring accountability for the use of force. The Government of Albania is expected to address the concerns raised through transparency, the conduct of independent investigations, and responsiveness to citizens’ demands, and to ensure its practical compliance with its international human rights obligations.
